Welcome to JagBuddies. These Terms and Conditions govern your use of our website at https://jagbuddies.co.za and any purchases made through it. By accessing or using our website, you agree to be bound by these terms. If you do not agree, please do not use our website.

JagBuddies is an online retailer operating in the Republic of South Africa. All transactions conducted through this website are subject to South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

3. Products & Pricing

We make every effort to ensure that product descriptions, images and prices on our website are accurate. However:

• All prices are quoted in South African Rand (ZAR) and include VAT at the current rate of 15%, unless otherwise stated.
• Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of placing your order.
• Product images are for illustrative purposes and may differ slightly from the actual product.
• We reserve the right to correct any pricing errors. If a product is listed at an incorrect price, we will contact you before processing the order.
• Product availability is not guaranteed. If an item is out of stock after your order has been placed, we will notify you and offer a refund or alternative.

4. Orders & Payment

When you place an order through our website:

• Your order constitutes an offer to purchase. We reserve the right to accept or decline any order.
• A confirmation email will be sent upon receipt of your order. This does not constitute acceptance of your order.
• Acceptance of your order occurs only when we dispatch the goods or confirm dispatch via email.
• Payment is processed securely via PayFast. We accept credit cards, debit cards, instant EFT, and other payment methods supported by PayFast.
• Full payment must be received before goods are dispatched.
• We do not store your credit card or banking details on our servers.

• We deliver nationwide within South Africa using reputable courier services.
• Delivery timeframes are estimates and are not guaranteed.
• Risk in the goods passes to you upon delivery.
• You are responsible for ensuring someone is available to receive the delivery at the specified address.

6. Returns & Refunds

• In terms of the Consumer Protection Act, you may return goods purchased online within 7 (seven) days of delivery without reason (cooling-off period).
• Goods must be unused, in original packaging and in resaleable condition.
• Certain goods are excluded from returns, including competition tickets and items not in original condition.
• Refunds will be processed within 14 business days of receiving the returned goods.

7. Competition Terms

Competitions hosted on JagBuddies are subject to the following terms:

• Competitions are open to residents of South Africa only, unless otherwise specified.
• Participants must be at least 18 years of age.
• Each ticket purchased entitles the holder to one entry into the draw, unless otherwise stated.
• Draw dates and prize details are specified on each competition page.
• Winners will be selected by random draw and notified via the contact details provided at the time of purchase.
• Results are final and no correspondence will be entered into.
• Prizes are not transferable and cannot be exchanged for cash, unless specified otherwise.
• By entering a competition, you consent to your first name and general location being published as part of winner announcements.
• Competitions are conducted in accordance with the Consumer Protection Act, Section 36.
• Tickets for competitions are non-refundable.

8. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, product descriptions, photographs, software and code, is the property of JagBuddies or its content suppliers and is protected by South African and international copyright, trademark and intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this website without our prior written consent.
• The JagBuddies name, logo and branding are registered trademarks. Unauthorised use is strictly prohibited.
• Product names and brands referenced on this website are trademarks of their respective owners.

9. Limitation of Liability

To the fullest extent permitted by South African law:

• JagBuddies shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website or purchase of products.
• Our total liability for any claim arising from a transaction shall not exceed the amount paid by you for that specific order.
• We do not warrant that the website will be uninterrupted, error-free or free from viruses or other harmful components.
• We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, power failures, internet outages, or government actions.
• Nothing in these terms excludes or limits liability that cannot be excluded or limited under South African law, including liability under the Consumer Protection Act.

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms and Conditions. By using our website, you consent to the collection and use of your information as described in our Privacy Policy, in accordance with the Protection of Personal Information Act (POPIA).

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of the website shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
